Our Disciplinary Policy template can be used by all employers. This policy sets out the rules for both a disciplinary procedure and a capability procedure. It covers how managers will manage incidents of misconduct or tackle under-performance by staff.
The law requires employers to have in place a written disciplinary procedure complying with sections 3(1)(b)(i) and (c), of the Employment Rights Act 1996. The disciplinary policy can be (a) included in the employment contract (or statutory statement of employment terms) or (b) provided in a separate policy or staff handbook, so long as it is mentioned in the contract or statement.
